PURPOSE: to provide for an adequate transitional period for health claims referring to children’s development and health by amending Regulation (EC) N° 1924/2006 on nutrition and health claims made on foods.
LEGISLATIVE ACT : Regulation (EC) N° 109/2008 of the European Parliament and of the Council amending Regulation (EC) N° 1924/2006 on nutrition and health claims made on foods
CONTENT: to recall, Regulation (EC) N° 1924/2006 was adopted in order to establish rules relating to the labelling, presentation and advertising of foods. The provisions of this Regulation specify that health claims are prohibited unless i) they comply with the general and specific requirements set by the Regulation and ii) unless they are included in a Community list of authorised health claims.
This list is in the process of being established and its finalisation is not expected before 1 July 2007. Bearing this in mind transitional measures on health claims have been provided for. Two categories of health claims, however, were excluded from these transitional measures namely, claims concerning a reduction of disease and claims relating to children’s development and health.
In a bid to prevent market disruption this Regulation provides that health claims referring to a reduction of disease risk claims; children’s development and health benefit from, the same transitional provisions as those specified in Regulation (EC) N° 1924/2006.
