Intelligent transport systems in the field of road transport: period for adopting delegated acts
The European Parliament adopted by 615 votes to 36, with 18 abstentions, a legislative resolution on the proposal for a decision of the European Parliament and of the Council amending Directive 2010/40/EU as regards the period for adopting delegated acts.
The European Parliaments position, adopted at first reading under the ordinary legislative procedure, amended the Commission proposal as follows:
Parliament clarified that the Commission shall have the power to adopt delegated acts with regard to the specifications necessary to ensure compatibility, interoperability and continuity for the deployment and operational use of Intelligent Transport Systems (ITS) for the priority actions.
The Commission shall adopt such acts for a period of five years from 27 August 2017. This period may be tacitly extended for periods of an identical duration, unless the European Parliament or the Council opposes this extension.
The delegation of power may be revoked at any time by the European Parliament or the Council.
Before adopting a delegated act, the Commission shall consult the experts designated by each Member State in accordance with the principles laid down in the Interinstitutional Agreement of 13 April 2016 on Better Lawmaking.
The Parliament and the Council shall have two months to express objections to a delegated act as from the notification of the act. This period shall be extended by two months at the initiative of the European Parliament or the Council.
The Commission shall update the working programme related to certain actions concerning specifications required for priority actions), and before each subsequent five-year extension of the power to adopt delegated acts.
