PURPOSE : to amend Regulation 881/2002/EC imposing certain specific restrictive measures against certain persons and entities associated with the Usama Bin Laden, the Al-Qaida network and the Taliban.
CONTENT : Council Regulation 881/2002/EC of 27 May 2002 implements, inter alia, the freezing of funds and economic resources provided for by Common Position 2002/402/CFSP (Please refer to procedure reference CNS/2002/0059).
The freezing measures were imposed in conformity with Resolutions 1267(1999), 1333(2000) and 1390(2002) of the Security Council of the UN. By means of Resolution 1452(2002) of 20 December 2002, the Security Council decided that provision has to be made for certain exemptions and exceptions to the freezing of funds and economic resources.
It is for this reason that this Regulation should be amended to bring it into line with the Common Position 2002/402/CFSP and the Resolutions to which it refers.
As regards the exemptions, they will facilitate the application of freezing measures. These exceptions should be granted on grounds of humanitarian need and are subject to approval by the Sanctions Committee.
It should also be noted that Resolution 1452(2002), which was adopted on the initiative of the EU members of the Security Council, addresses the concerns about possible infringement of fundamental rights, as expressed by the European Parliament in its Opinion of 11 April 2002 (please refer to procedure reference CNS/2002/0059).�
