Reference laboratories for the monitoring of marine biotoxins

The Committee has adopted the draft report by its Chair, Carmen Fraga Estévez (EPP, E), on the legal basis for the proposal and the modified proposal for a Parliament and Council decision amending Decision 93/383/EEC on reference laboratories for the monitoring of marine biotoxins. The rapporteur disputes the appropriateness of the legal basis proposed by the Council and, having consulted the Committee on Legal Affairs and Citizens' Rights, argues that the Commission proposal should be based on Article 100a, not Article 43, of the EC Treaty. In essence, Parliament wants to have the power of codecision rather than ordinary consultation.�
