OBJECTIVE: to amend Directive 97/12/EC, particularly with regard to the deadline granted to
the Member States for transposing the provisions and introducing new rules concerning the
control and supervision of diseases.
COMMUNITY MEASURE: Council Directive 98/99/EC amending Directive 97/12/EC
amending and updating Directive 64/432/EEC on health problems affecting intra-Community
trade in bovine animals and swine.
CONTENTS: the amendment seeks to delay the time limit by which Member States must comply
with the new Annexes to Directive 64/432/EEC by one year (currently 1 July 1998 according to
Directive 97/12/EC).
It should be noted that the Commission based its proposal on Articles 43 and 100 A of the Treaty
(co-decision), while the Council only referred to Article 43. The Commission confirmed its
reservation with regard to the change made to the legal basis during negotiations when the
measure was adopted.
ENTRY INTO FORCE: 31 December 1998
DEADLINE FOR TRANSPOSITION: 1 July 1999 and 1 January 1999 depending on the
provisions.�
