On 21 April 2004, Parliament delivered its opinion on this proposal, in accordance with the procedure foreseen by Article 308 of the Treaty. However, following considerable debate amongst the Member States in Council, it was decided that the legal basis for this particular proposal should be changed and that the European Parliament should be re-consulted in accordance with the new legal basis – in other words Article 152, co-decision. Accordingly, the Commission is submitting a new proposal based on Article 152 of the Treaty (COM(2005)0399 – 2005/0166 COD), which will replace the previous proposal. Procedure 2003/0311 has thus been terminated.
