Request for the defence of parliamentary immunity of Ashley Mote

2007/2122(IMM)

The committee adopted the report by Francesco Enrico SPERONI (UEN, IT) on the request for defence of the immunity and privileges of Ashley MOTE (ITS, UK) in connection with criminal proceedings brought against him in the territory of the United Kingdom.

The committee pointed out that Article 10 of the Protocol of 8 April 1965 on the Privileges and Immunities of the European Communities provides that, during the sessions of the European Parliament, its members shall enjoy "in the territory of their own State, the immunities accorded to members of their parliament.......". However, Members of the UK Parliament do not enjoy immunity from criminal prosecution. The committee accordingly recommended that Parliament should not defend the immunity and privileges of Mr Ashley Mote, given that he has no immunity to defend.
