The European Parliament adopted the recommendation for second reading by Mr MEDINA ORTEGA. Since the amendments tabled by the Commission following the EP's opinion at first reading had been included in the common position, the adopted report only incorporated some minor amendments to the Council's common position: - the right of access to data for persons should not adversely affect trade secrets; - "controller" should mean the natural or legal person, public authority, agency or any other body which, alone or jointly with others, determined the purposes and means of the processing of personal data; - Member States could provide for exemptions or derogations for the processing of personal data carried out solely for journalistic purposes or the purpose of artistic or literary expression only if they were necessary to reconcile the right to privacy with the rules governing freedom of expression. �
