PURPOSE: to codify Regulation 26/62/EEC on applying certain rules of competition to the production of, and trade in, agricultural products.

LEGISLATIVE ACT: Council Regulation 1184/2006/EC applying certain rules of competition to the production of, and trade in, agricultural products.

CONTENT: this Regulation has been adopted in order to codify Regulation 26/62/EEC, which has been amended frequently.

In addition, this Regulation extends Article 81 and Article 86, (competition and dominant position), of the Treaty to the production of, and trade in, agricultural products – in so far as their application does not impede national organisations of agricultural markets or jeopardise CAP’s objectives. This latter provision applies, in particular, to farmers’ organisations who rely on joint production or who use joint facilities. The Commission will draw up a list of existing, new or proposed types of aid.
