- OBJECTIVE: Council Directive 95/53/EC lays down at Community level the principles relating to the organisation of inspections in the field of animal nutrition.
- SUBSTANCE:
- inspections which are carried out on a regular basis, in cases where non-compliance is suspected, and in a manner which is proportionate to the objective being pursued. These inspections cover all stages of production and manufacture, including intermediate stages prior to the products being put into circulation, as well as the marketing process itself, including the importation and use of the products concerned;
- documentary and systematic identity checks, as well as physical checks by the taking of samples from products imported from non-member countries;
- inspections which are reinforced at the point of origin and the organisation of inspections at the destination point within the framework of intra-Community trade;
- establishing cooperation between Member States in cases where an offence has been committed and the introduction of inspections on agricultural premises;
- Member States are to draw up a list of laboratories responsible for carrying out the analysis work; these establishments are to ensure that the sampling and analyses are undertaken in accordance with Community regulations;
-application of sanctions in cases involving violation of the measures which have been adopted for the application of the directive;
- the directive does not affect the appeal procedures which are opened by national legislations against the decisions of the appropriate authorities; once duly substantiated, these decisions have to be made known to the operator concerned;
- Member States shall establish, by 01.10.1998 at the latest, programmes which specify the national measures to be implemented.
